Terms & Conditions

These Terms & Conditions apply to all orders placed with Just Fabrics Ltd (“Just Fabrics”, “we”, “us”, “our”) via our website, by telephone, in store, or through consultation.
By placing an order, you agree to be bound by these Terms.
Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or other applicable consumer protection legislation.

References to “we”, “us” and “our” mean Just Fabrics Ltd.

 

2. Product Information & Samples

We take reasonable care to ensure that product descriptions, images, specifications and prices are accurate.

However:
•    Colours may vary due to screen settings and lighting conditions.
•    Natural fabrics (such as linen or silk) may contain inherent characteristics including slubs or irregularities which are not faults.
•    Batch and dye variations may occur between production runs.
Fabric samples are intended to provide a general indication of colour, texture and pattern. Minor variations may occur between samples and final fabric supplied.
We strongly recommend ordering samples before purchasing fabric or made-to-measure items.

3. Order Process & Contract Formation

All products displayed on our website constitute an invitation to treat and not an offer to sell.

When you place an order, you are making an offer to purchase goods at the price displayed at the time of ordering.
After placing your order you will receive an order acknowledgement email confirming receipt of your order. This does not constitute acceptance.
A legally binding contract is formed only when we confirm dispatch of the goods.

We reserve the right to decline or cancel any order prior to dispatch where:
•    A product is out of stock
•    A pricing or technical error has occurred
•    We suspect fraudulent activity
•    Delivery restrictions apply
If we cancel your order before dispatch, a full refund will be issued.

4. Pricing & Technical Errors

We take reasonable care to ensure pricing accuracy. However errors may occasionally occur, including:
•    typographical errors
•    software or technical faults
•    configurator miscalculations
•    data feed or app errors
If a pricing error is identified before dispatch we will notify you as soon as reasonably possible and give you the option to:
•    proceed at the correct price; or
•    cancel the order for a full refund.

Payment being taken does not constitute acceptance of your order.

5. Discount Codes & Promotions

From time to time we may offer promotional discounts or voucher codes.
Unless stated otherwise:
•    Only one discount code may be used per order.
•    Discount codes cannot be combined with other promotions.
•    Discount codes cannot be applied retrospectively to orders already placed.
•    Certain products, brands or services may be excluded from promotions.

Discount codes have no cash value and cannot be exchanged for cash.
We reserve the right to withdraw or amend promotions where an error has occurred or misuse is suspected.

6. Fabric Sold by the Metre – Inspection & Cutting

Fabric cut to a length specified by the customer is prepared to your individual requirements and is exempt from cancellation under Regulation 28(1)(b) of the Consumer Contracts Regulations 2013.
All fabric must be fully measured and inspected immediately upon delivery and before any cutting, alteration, processing or installation takes place.

Inspection should include checking:
•    The correct product has been supplied
•    The quantity supplied is sufficient
•    The colour and batch are acceptable
•    The fabric is free from visible defects or damage

Fabric should be inspected across its full width and length before cutting.
If fabric is being supplied to a curtain maker, upholsterer, workroom or other third party, it is the customer’s responsibility to ensure the fabric has been fully inspected before any cutting or making up takes place.
Once fabric has been cut, altered, processed or made up, it will be considered accepted unless the issue relates to an inherent manufacturing fault that would not reasonably have been apparent upon reasonable inspection prior to cutting.
Fabric quantities are supplied in accordance with the length ordered by the customer.
Customers are responsible for ensuring sufficient fabric is ordered for their intended project before cutting or making up.
We may include inspection guidance within parcels reminding customers to check fabric before cutting.

7. Third-Party Workrooms & Installers

Where fabric is supplied for use by a curtain maker, upholsterer, workroom, interior designer or other third party, it remains the customer’s responsibility to ensure the fabric has been inspected and accepted prior to cutting or installation.

Just Fabrics Ltd cannot accept responsibility for labour costs, manufacturing costs, fitting charges or other third-party expenses incurred before the fabric has been inspected and accepted as satisfactory.

Our liability in relation to any claim is limited to the value of the fabric supplied.

8. Made-to-Measure & Bespoke Products

Prices for made-to-measure, bespoke or customised goods are calculated based on the measurements and specifications provided by you.

Made-to-measure and personalised goods are exempt from the 14-day cancellation right under Regulation 28(1)(b) of the Consumer Contracts Regulations 2013.
Once production has commenced, bespoke orders cannot be cancelled or returned due to change of mind.

This does not affect your statutory rights where goods are faulty or misdescribed.

9. Your Right to Cancel (Standard Goods Only)

For standard goods purchased online or at a distance you have the right to cancel within 14 days of receiving the goods under the Consumer Contracts Regulations 2013.

This right does not apply to:
•    made-to-measure goods
•    bespoke or personalised products
•    fabric cut to your specified length

Returned goods must be unused and in resaleable condition.
Return postage is the responsibility of the customer unless goods are faulty.

10. Delivery

Orders placed through our website can currently be delivered to UK addresses only.
Dispatch times are estimates and may vary during busy periods.
Risk passes to you once goods are delivered.
Ownership of goods passes once full payment has been received.
Customers should inspect goods promptly upon delivery and notify us of any visible damage as soon as reasonably possible.

11. Use of Freight Forwarding Services

Some customers may choose to arrange onward international delivery using a third-party freight forwarding service that provides a UK delivery address.
Where a UK delivery address is provided, the order will be treated as a UK domestic delivery.

Responsibility for any onward international shipping, customs clearance, duties, taxes or import charges rests with the freight forwarding provider and the recipient.

12. Limitation of Liability

Nothing in these Terms excludes or limits liability for:
•    death or personal injury caused by negligence
•    fraud or fraudulent misrepresentation
•    breach of statutory consumer rights

Subject to the above, our liability in relation to any claim shall not exceed the value of the goods supplied.

We are not liable for business losses, including loss of profit, revenue or opportunity.

13. Privacy & Marketing

We process personal data in accordance with our Privacy Policy.
Customers may opt out of marketing communications at any time.

14. Governing Law

These Terms are governed by the laws of England and Wales.
If you are a consumer, you may bring proceedings in England and Wales or in the courts of your country of residence where applicable consumer law permits.
